What has the AI literacy duty required since the Digital Omnibus?
The original text said providers and deployers should ensure, to their best extent, a sufficient level of AI literacy. Since 27 July 2026 the version from Regulation (EU) 2026/1744 applies, and it is more modest: take measures that support the development of AI literacy, without guaranteeing a particular level for any individual. A new paragraph also says the Commission and the member states support businesses, small and medium-sized ones in particular.
How do you document your team's AI literacy?
No certificate is needed, says the European Commission, and the Bundesnetzagentur also lists standardised trainings and a dedicated AI officer among the things that are not mandatory. What remains is a plain file: which AI tools are in use, who uses them, when training took place and on what, and when the next refresher is due. Authorities have been enforcing the duty since August 2026, and if one asks, that file is what you hand over.
Which content makes AI literacy training useful?
The regulation prescribes no format, but it does name yardsticks, namely technical knowledge, experience, education and training, and the context in which the systems run. In practice that gives four building blocks: a basic understanding, your own role as provider or deployer, the risks of the specific tools and regular refreshers. People who know where a chatbot makes up facts check results before they reach customers (the Bundesnetzagentur calls this, quite soberly, the companies' own interest).

Is there a fine for missing AI literacy?
The often quoted 35 million euros apply to prohibited practices under Article 5; there is no separate range for Article 4. According to the European Commission, national authorities can still impose penalties under national law. And the Bundesnetzagentur notes that a lack of AI literacy can count as a breach of the duty of care.
